DIVISION OF PROFESSIONAL REGULATION

28-22-1. Division established. --Within the department of labor and training there shall be a division of professional regulation, and the director of labor and training shall appoint an administrator of the division, in accordance with the provisions of chapter 4 of title 36. The administrator shall act as the administrative agent for the examining boards established by this title and perform such other functions as assigned to him by this title.

28-22-1.1 Restricted receipts account. -- From the proceeds of any fee collected pursuant to the provisions of chapter 6 of title 5 entitled "Electricians": chapter 26 of this title entitled "Hoisting Engineers": and chapter 27 of this title entitled "Pipefitters and Refrigeration Technicians", there is hereby created a common restricted receipts account which shall be used solely to pay for the administrative expenses incurred in administering these respective chapters. Any remaining balances in restricted receipts accounts created in chapter 6
of title 5 and chapter 27 of this title as of June 30, 1989 shall be credited to the restricted account hereby created.

28-22-2 Penalties for non-payment. -- Any person who has violated any provisions of chapter 6 of title 5 entitled "Electricians," chapter 26 of title 28 entitled "Hoisting Engineers," chapter 27 of title 28 entitled "Pipefitters and Refrigeration Technicians, Fire Protection Sprinkler Contractors and Journeyperson Sprinkler Fitters, Sheet Metal Workers, and Oil Heat Contractors," chapter 70 of title 5 entitled "Telecommunications," and chapter 20 of title 5 entitled "Plumbers," whether duly registered with the office of the secretary of state or not, and has been levied a fine by the Director of Labor and Training, is hereby required to submit penalties due to the Department of Labor and Training, Division of Professional Regulation, within thirty (30) days of notice of the fine or penalty or license(s) will be revoked. Reinstatement of said license(s) will require payment of all penalties due to the Department of Labor and Training and a subsequent hearing before the respective board. Any person who has violated any provisions of chapter 6 of title 5 entitled "Electricians," chapter 26 of title 2 entitled "Hoisting Engineers," chapter 27 of title entitled "Pipefitters and Refrigeration Technicians, Fire Protection Sprinkler Contractors and Journeyperson Sprinkler Fitters, Sheet Metal Workers and Oil Heat Contractors," chapter 70 of title 5 entitled "Telecommunications," and chapter 20 of title 5 entitled "Plumbers," whether duly registered with the office of the secretary of state or not, and has been levied a fine by the Director of Labor and Training, and is not licensed with the Department of Labor and Training, Division of
Professional Regulation, is hereby required to submit penalties due to the Department of Labor and Training, Division of Professional Regulation, within thirty (30) days of notice of the fine or penalty, or the Director of the Department of Labor and Training shall have the power to institute injunction proceedings in superior court.

--- RULES AND REGULATIONS ---


1. A licensing board may give an oral examination to an applicant for a license issued under the provisions of chapter 5-6, 28-26, 28-27, 5-70, and 5-20 where the board determines that:

a) an applicant cannot read or write English (except that the applicant must be able to read any sign or notice dealing with legal safety requirements).

b) an applicant can document that he/she has a learning or physical disability which would handicap that
individual in taking a written examination.

c) the board may authorize a field examination in the case of an emergency or other extenuating circumstances such as limited license of employees in the public sector.

d) an applicant must provide and pay any expense connected with an interpreter when taking an oral examination.

e) an interpreter shall not be licensed in the subject matter for which the oral examination is given.


2. In the event that a registration or license issued under the provisions of chapter 5-6, 28-26, 28-27, 5-70, 5-20, or 28-45 is lost or destroyed, the person to whom the same was issued may make application for and upon payment of the required fee of ten dollars ($10.00) obtain a duplicate registration or license, upon furnishing proof satisfactory to the division of professional regulation that such registration or license has been lost or destroyed.


3. In the event that a payment for a registration or license issued under the provisions of chapters 5-6, 28-26, 28-27, 5-70, 5-20, or 28-45 is deemed improper for the reason of insufficient funds or closed account, said license will be invalid until the person to whom the infraction has incurred submits the required registration or license, plus twenty-five (25%) penalty of the total check amount, in the form of a certified check or money order to the division.


4. Any person with a pending violation of chapter 5-6, 28-26, 28-27, 5-70, or 5-20, will not be permitted to
take an examination for a license issued under the provisions of chapters 5-6, 28-26, 28-27, 5-70, or 5-20,
until such time as the fine and/or violation has been settled.
